Ethical Review and Accountability Framework (ERAF)

Purpose and Scope

Purpose of ERAF

The Ethical Review and Accountability Framework (ERAF) is established by LymeCare Alliance Ltd. to ensure the maintenance and promotion of high ethical standards within the Lyme disease community. The ERAF serves to review, assess, and address any ethical or moral misconduct that may adversely impact the community, ensuring that such conduct aligns with the values and mission of LymeCare Alliance Ltd.

Scope of ERAF

The ERAF shall apply to:

  • External Individuals: Any individual who, through their actions, may have engaged in behavior deemed unethical, harmful, or morally questionable, affecting Lyme disease patients, their families, or the broader community.
  • External Organizations: Any organization whose activities or practices may have caused harm, misrepresentation, or unethical impact on the Lyme disease community.

Ethical Review Board (ERB)

Establishment and Composition

Establishment: The Ethical Review Board (ERB) shall be established as the principal body within the ERAF, tasked with the review and assessment of ethical cases brought before it.

Composition: The ERB shall consist of a minimum of five (5) and a maximum of twenty-one (21) members, including but not limited to experts in ethics, legal professionals, community representatives, and other relevant stakeholders as deemed appropriate by the Board of Directors of LymeCare Alliance Ltd.

Appointment, Tenure, and Removal

Appointment Process: Members of the ERB shall be nominated by the Board of Directors and appointed following a majority vote of the board.

Tenure: Members of the ERB shall serve a term of two (2) years, with eligibility for reappointment upon the expiration of their term.

Removal: The Board of Directors reserves the right to remove any ERB member before the completion of their term if the member is found to act against the interests of the ERB, the organization, or any member of LymeCare Alliance Ltd. In such cases, the Board of Directors may appoint a new member to serve the remainder of the term.

Powers and Duties

Review Authority: The ERB shall have the authority to conduct initial assessments, fact-finding inquiries, and full ethical reviews of cases submitted under the ERAF.

Community Involvement: Members of the LymeCare Alliance Ltd. community shall have the right to participate in the ethical review process by providing votes and opinions on cases under review, functioning in a capacity similar to jurors. The community's input shall be gathered through an approved online platform designated by the organization.

Recommendations: The ERB shall issue findings and recommendations based on its ethical review. These recommendations may include public statements, corrective actions, or guidance to prevent future occurrences.

Confidentiality: The ERB shall maintain strict confidentiality throughout the review process, disclosing information only as necessary for the resolution of the case or as required by law.

Submission and Review of Cases

Submission Process

Eligibility to Submit: Any individual or entity within the Lyme disease community, including patients, healthcare providers, family members, or the general public, may submit a case for ethical review to the ERB.

Submission Requirements: All submissions must include a detailed account of the alleged unethical behavior, supporting evidence, and a statement regarding the impact on the community. The ERB shall provide a standardized form to facilitate submissions.

Initial Assessment

Preliminary Review: Upon receiving a submission, the ERB shall conduct a preliminary review to determine the validity and relevance of the case within the scope of the ERAF.

Notification: The subject of the review shall be notified in writing of the allegations and shall be given an opportunity to respond before a full review is initiated.

Ethical Review Process

Conducting the Review

Fact-Finding: The ERB shall undertake a thorough fact-finding process, which may include the collection of evidence, interviews with relevant parties, and consultations with experts. This process shall be conducted through an approved online platform to ensure accessibility and efficiency.

Ethical Evaluation: The ERB shall evaluate the facts against the ethical principles and standards as established by LymeCare Alliance Ltd. and articulated in the Code of Ethics.

Findings and Recommendations

Issuance of Findings: Upon concluding the review, the ERB shall issue its findings in a written report, which shall include an analysis of the ethical implications and any recommendations for action.

Private Records: All cases and final decisions shall be recorded in private organizational records. These records shall contain the full information of the case, including the identities of the involved parties.

Public Announcement: The final decisions shall be announced publicly with non-disclosed names of the accused parties. In specific cases, following the decision of the Board of Directors and/or the ERB, the organization may publish the full details of the case publicly.

Access to Private Decisions: A copy of the private final decision document shall be provided to both the claimant and the accused, but only after the accused has formally requested it through an approved contact method as designated by the organization.

Appeals Process

Right to Appeal

Submission of Appeals: The subject of an ethical review may submit an appeal of the ERB's findings within thirty (30) days of receiving the written report.

Appeals Committee: An independent Appeals Committee, consisting of members not involved in the original review, shall be constituted to consider the appeal and make a final determination.

Finality of Decisions

Final Decision: The decision of the Appeals Committee shall be final and binding within the context of the ERAF. No further appeals or reviews shall be entertained within the organization.

Public Registry of Ethical Findings

Maintenance of the Registry

Public Registry: LymeCare Alliance Ltd. shall maintain a public registry of ethical findings, detailing the cases reviewed, the findings of the ERB, and any recommendations issued.

Transparency: The registry shall be made publicly available in a manner that promotes transparency while safeguarding the privacy and rights of the individuals and organizations involved.

Code of Ethics

Development and Implementation

Establishment: LymeCare Alliance Ltd. shall develop and implement a comprehensive Code of Ethics that shall guide the decisions and actions of the ERB, as well as the broader activities of the organization.

Adherence: All members, employees, and volunteers of LymeCare Alliance Ltd. shall be required to adhere to the Code of Ethics, and any violations may be subject to review under the ERAF. Read the Code of Ethics

Communication and Media Relations

Official Communication

Communications: All communications regarding the ERAF, including public statements, registry entries, and media interactions, shall be conducted in a clear, respectful, and legally compliant manner.

Spokespersons: Designated spokespersons, who are well-versed in the ERAF and its processes, shall handle all media inquiries and public communications related to ethical reviews.
